‍Service: The WriteNow Care platform that facilitates access to mental health and counseling services.

‍Start Date: The date you first access or use the Service.

‍You or Your: Refers to the individual using our Service.

3. Services provided

3.1. WriteNow Care provides an online platform for users to access mental health support, including consultations with licensed professionals.

3.2. All healthcare providers offering services through WriteNow Care are independent contractors and not employees of Project WNC Inc. We do not control, endorse, or assume liability for their professional advice.

3.3. Emergency Services Disclaimer: If you are experiencing a crisis, including thoughts of self-harm, harming others, or a medical emergency, call 911 or go to the nearest emergency room immediately. The Service is not a substitute for crisis intervention or emergency medical care.

4. Compliance with HIPAA & Data protection

4.1. Collection & Use of Health Information

  • We collect, store, and process PHI in compliance with HIPAA, the Health Information Technology for Economic and Clinical Health (HITECH) Act, and applicable U.S. state privacy laws.
  • Your PHI may be used to provide services, process payments, and improve healthcare delivery.

4.2. Security Measures

  • We implement administrative, physical, and technical safeguards, including data encryption, access controls, and regular security audits.

4.3. Third-Party Disclosures

  • We only share PHI with healthcare providers, insurance companies, and third parties as permitted by HIPAA and only under Business Associate Agreements (BAAs).

    • Upload harmful content, including viruses or misleading information.
    • Engage in abusive, discriminatory, or illegal behavior when interacting with counselors or other users.

5.3. Consent for Emergency Contact

  • By using the Service, you consent to providing emergency contact details. Your designated contact may be notified if a healthcare provider determines there is a significant risk to your safety.

6. Intellectual property rights

6.1. Ownership

  • All content, trademarks, software, and data provided via the Service remain the exclusive property of Project WNC Inc.

6.2. User-Generated Content

  • By submitting feedback or content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and modify your submissions to improve our services.

7. Fees and payment

  • Fees for counseling services are disclosed in advance and may be paid through approved payment methods.

7.2. Refunds & Cancellations

  • Refunds are only available for unused services within the allowed cancellation period as specified in our refund policy.

8. Limitation of liability

8.1. No Warranty

  • The Service is provided "as is" without warranties of any kind. We do not guarantee availability or uninterrupted access.

8.2. Liability Cap

  • Our maximum liability for any claims related to the Service will not exceed the total amount paid by you for services within the last six months.

8.3. Indemnification

  • You agree to indemnify and hold harmless Project WNC Inc. from any claims arising from your misuse of the Service.
